Agreement to Terms
By accessing or using Nightline's AI receptionist services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our Services.
Description of Services
Nightline provides AI-powered after-hours receptionist services for tax relief firms. Our AI assistant, Mason, handles incoming calls, conducts client intake, schedules appointments, and provides call summaries to subscribing businesses.
For Business Subscribers
If you are a tax relief firm subscribing to our Services:
- You are responsible for ensuring your use of our Services complies with all applicable laws and regulations, including those governing client communications in your jurisdiction.
- You must provide accurate business information and maintain updated calendar and contact details.
- You are responsible for informing callers that they may be speaking with an AI assistant and that calls may be recorded.
- Subscription fees are billed according to your selected plan. All fees are non-refundable except as required by law.
For Callers
If you are calling a phone number serviced by Nightline:
- You acknowledge that you may be speaking with an AI assistant, not a human representative.
- Your call may be recorded and transcribed for quality assurance and to provide services to the business you are contacting.
- Information you provide will be shared with the tax relief firm you are calling.
Acceptable Use
You agree not to:
- Use our Services for any unlawful purpose
- Attempt to interfere with or disrupt our Services
- Impersonate any person or entity
- Transmit any harmful code, viruses, or malicious content
- Use our Services to harass, abuse, or harm others
- Attempt to reverse engineer or extract our AI technology
Intellectual Property
The Services, including our AI technology, software, branding, and content, are owned by Nightline and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Disclaimer of Warranties
Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, secure, or error-free. Our AI assistant is not a substitute for professional legal or tax advice.
Limitation of Liability
To the maximum extent permitted by law, Nightline shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our Services. Our total liability shall not exceed the amount paid by you for our Services in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Nightline, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our Services or violation of these Terms.
Termination
We may terminate or suspend your access to our Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use our Services will immediately cease.
Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Continued use of our Services after changes constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
